<title>The Interconnection Landscape Changes Yet Again: FERC Conditionally Accepts the California ISO&apos;s Interconnection Queue Reform Phase 2</title>
<description><![CDATA[<p>On January 31, 2012, the Federal Energy Regulatory Commission (FERC) conditionally accepted additional reforms to the California ISO&rsquo;s Generator Interconnection Procedures (GIP) that significantly change the rules that apply to developers seeking to interconnect power generation facilities in the California ISO&rsquo;s balancing authority area.</p>
<p>The decision continues the California ISO&rsquo;s efforts to reform the GIP that began in 2008, and focuses on 18 specific issues that arose from stakeholder efforts, interconnection agreement negotiations, the California ISO&rsquo;s transmission planning process, or that were carried over from the previous round of reforms.</p>
<p>The reforms addressed the following issues and more:</p>

&bull; Posting of Security and Reimbursement of Costs for Network Upgrades <br />

<title>Federal Court Holds That the Migratory Bird Treaty Act Does Not Apply to Lawful Activities That Result in the Incidental Taking of Protected Birds</title>
<description><![CDATA[<p>A legal update from our colleagues <a href="http://www.stoel.com/showbio.aspx?Show=454&amp;tab=59">Per Ramfjord</a> and <a href="http://www.stoel.com/showbio.aspx?show=5949">Steve Galloway</a>:</p>
<p>In a recent opinion, the United States District Court for the District of North Dakota dismissed misdemeanor criminal charges against three oil and gas companies for violation of the Migratory Bird Treaty Act (&ldquo;MBTA&rdquo;) arising out of the incidental death of migratory birds through contact with oil reserve pits operated by the defendants. <em>United States v. Brigham Oil &amp; Gas, L.P., </em>No. 4:11-po-005-DLH et al., 2012 U.S. Dist. LEXIS 5774 (D.N.D. Jan. 17, 2012). This opinion is significant because it represents the latest in a number of cases that have interpreted the MBTA in a manner that does not criminalize the inadvertent taking of migratory birds.</p>
<p>By way of background, the MBTA was enacted in 1918 to implement four international treaties aimed at protecting migratory birds. The Act makes it unlawful &ldquo;by any means or in any manner&rdquo; to &ldquo;take&rdquo; or attempt to &ldquo;take&rdquo; any of approximately 800 species of migratory birds, including most common birds other than pigeons and starlings. Regulations promulgated under the Act further define the term &ldquo;take&rdquo; as to &ldquo;pursue, hunt, shoot, wound, kill, trap, capture, or collect&rdquo; any such birds. Companies or individuals who violate these provisions face misdemeanor criminal penalties that can result in fines of up to $15,000 per bird and/or six months&rsquo; imprisonment.</p>

<title>California Energy Commission Issues 2011 Integrated Energy Policy Report</title>
<description><![CDATA[<p>Yesterday, the California Energy Commission (CEC) issued a notice that, as part of the CEC&rsquo;s February 8, 2012 Business Meeting, the Commission will consider adoption of the Lead Commissioner&rsquo;s Final <a href="http://www.energy.ca.gov/2011_energypolicy/index.html">2011 Integrated Energy Policy Report</a> (IEPR).&nbsp;</p>
<p style="margin: 0in 0in 0pt">The CEC&rsquo;s notice included the following information:<br />
<br />
<b>Background</b> <br />
Senate Bill 1389 requires the CEC to adopt an integrated energy policy report every two years. The objective of the IEPR is to evaluate market trends and develop energy policies that will &quot;conserve resources, protect the environment, ensure energy reliability, enhance the state's economy, and protect public health and safety.&quot; The Final 2011 IEPR has been prepared in response to this direction and is available on the CEC&rsquo;s website.<br />
<br />
To prepare the report, the Energy Commission conducted 30 public workshops on a range of issues facing California's electricity, natural gas, and transportation fuel sectors. On December 5, 2011, the Energy Commission released the Draft 2011 IEPR to solicit public comments. The Final 2011 IEPR considers all written comments on the draft report. <br />

<b>Written Comments<br />
</b>The Energy Commission will accept comments on the Final 2011 IEPR and requests parties to submit comments in writing by February 1, 2012, so that comments can be considered before &nbsp;the February 8, 2012, Business Meeting. Comments will also be accepted at the Business Meeting. &nbsp;&nbsp;<br />

<title>CPUC Adopts Decision Implementing RPS Portfolio Content Categories</title>
<description><![CDATA[<p>A legal update from our colleagues <a href="http://www.stoel.com/seth_hilton">Seth Hilton</a> and <a href="http://www.stoel.com/allison_smith">Allison Smith</a>:</p>
<p>On December 15, 2011, the California Public Utilities Commission adopted Decision 11-12-052, implementing Portfolio Content Categories for the 33% Renewables Portfolio Standard (RPS) Program in California. The Decision implements portions of Senate Bill (S.B.) x1-2, which created the 33% RPS Program. S.B. x1-2 established three categories of RPS-eligible electricity, applicable to RPS contracts executed after June 1, 2010:</p>
<ul>
    <li>Category One includes electricity from RPS-eligible resources that have their first point of interconnection with a California balancing authority, RPS-eligible resources with a dynamic transfer arrangement with a California balancing authority, and RPS-eligible resources scheduling their electricity directly into a California balancing authority without substituting electricity from another source.<br />
    <br />
    &nbsp;</li>
    <li>Category Two includes firmed and shaped RPS-eligible electricity.<br />
    <br />
    &nbsp;</li>
    <li>Category Three includes transactions that do not meet the criteria of Category One or Two, including unbundled renewable energy credit (REC) transactions.<br />

<title>FERC Rules Against Bonneville Power Administration&apos;s Environmental Redispatch Policy</title>
<description><![CDATA[<p>A legal update from our colleagues <a href="http://www.stoel.com/showbio.aspx?show=503">Steve Hall</a>, <a href="http://www.stoel.com/showbio.aspx?show=3286">Dina Dubson</a> and <a href="http://www.stoel.com/showbio.aspx?show=2800">Jason Johns</a>:</p>
<p>On December 7, 2011, the Federal Energy Regulatory Commission issued an order holding that the Bonneville Power Administration violated Section 211A of the Federal Power Act by curtailing wind energy under BPA&rsquo;s Environmental Redispatch policy and&nbsp;requiring BPA to file a revised transmission tariff within 90 days from the date of the order.</p>

<title>Energy Law Alert: BIA Proposes Regulations for Surface Leases of Trust Land for Energy and Other Uses</title>
<description><![CDATA[<p>A legal update from our colleagues <a href="http://www.stoel.com/showbio.aspx?Show=433&amp;tab=49">Michael O'Connell</a> and <a href="http://www.stoel.com/showbio.aspx?show=2424">Stephen&nbsp;Kelly</a>:</p>
<p>The Bureau of Indian Affairs (BIA) on November 29, 2011 published proposed regulations for leasing tribal and individual Indian trust land for business and residential uses. The comment period runs through January 30, 2012. It will take the BIA some time to review and respond to comments before issuing final regulations. The Federal Register notice for the proposed new regulations runs 44 pages. <a href="http://www.stoel.com/files/Proposed_Part162_Regs_Nov2011.pdf"><em>See</em> 76 Fed. Reg. 73,784 (Nov. 29, 2011)</a>.</p>
<p>The BIA's proposed regulations apply to surface leases of trust land. Subsurface leases and mineral development agreements are governed by different regulations and statutes, as are rights-of-way and contracts or agreements that encumber tribal land.</p>
<p>Revised Subpart D of the proposed regulations covers leases for biomass, waste-to-energy, and other commercial and business uses. Subpart E establishes procedures for Wind and Solar Resource Leases and short-term (three years, with an option for one renewal term of three years) Wind Energy Evaluation Leases (WEELs) for purposes of installing instrumentation and related infrastructure, such as met towers, to evaluate wind resources for electricity generation. No similar provision is included for solar energy evaluation leases on the theory that physical possession of land is not required to evaluate a solar resource. WEELs take the place of short-term BIA permits that were included in an earlier version of the draft regulations.</p>

<title>CUB Policy Center and UO Hold Inaugural Smart Grid Conference in Portland</title>
<description><![CDATA[<p>The <b><a href="http://cubpolicycenter.org/"><font color="#1b429a">CUB Policy Center</font></a></b>, in partnership with the <b><a href="http://www.law.uoregon.edu/"><font color="#1b429a">University of Oregon School of Law</font></a></b>,&nbsp;&nbsp;will be holding&nbsp;its inaugural policy conference: <b>Smart Grid: Today's Regulation and Tomorrow's Technology</b>, on <b>Friday, October 21, 2011</b>, at the <b>University of Oregon White Stag Block</b> (70 NW Couch St., Portland, OR 97209).&nbsp; The luncheon keynote speaker will be former FERC Commissioner Nora Mead Brownell, who is the co-founder of ESPY Energy Solutions.</p>
<p>The conference is designed to educate utility analysts, policy analysts, attorneys, industry professionals, stakeholders and others on the current regulatory environment in Oregon and the region and to provide a forum for investigating the opportunities and challenges of integrating the Smart Grid into that environment. The CUB Policy Center&nbsp;notes that space for this conference, which promises to be&nbsp;well attended, is limited&nbsp;and encourages&nbsp;attendees to register early.&nbsp; &nbsp;</p>
<p>I'll be participating in the Closing Panel to recap and discuss lessons learned during the day, and I hope to see you there.</p>]]></description>

<title>Great River Energy Issues Request for Proposals</title>
<description><![CDATA[<p>On August 15, 2011, Great River Energy (GRE) issued a request for proposals (RFP) for community-based energy development (C-BED) renewable energy resources.&nbsp; Eligible energy technologies include: wind, solar, hydroelectric of less than 100 megawatts, biomass, municipal solid waste, landfill gas and anaerobic digesters, and hydrogen produced from any of the previous resources.</p>
<p>In announcing the RFP, GRE noted that it already has enough renewable resources in its energy portfolio to meet Minnesota's Renewable Energy Standard.&nbsp; Minnesota's RES&nbsp;requires electric utilities to supply an increasing percentage of their energy sales from renewable energy sources, reaching 25 percent by 2025.&nbsp;Nevertheless, GRE issued the RFP to &quot;evaluate if additional C-BED renewable resources can provide value to our member cooperatives in the future,&quot; according to Jon Brekke, Great River Energy vice president of member services.&nbsp; GRE plans to evaluate proposals based on their impact to wholesale power rates and other factors.</p>
<p class="BodyText"><strong>Proposals are due before 4pm Central Prevailing Time on&nbsp;Sept. 9, 2011</strong>.&nbsp;&nbsp;GRE plans to&nbsp;notify short listed bidders by September 30 and has targeted November 1, 2011 as the execution&nbsp;date for&nbsp;a power purchase agreement&nbsp;(PPA).&nbsp;&nbsp;GRE is clearly looking for bargains&nbsp;from developers who can take advantage of the Section 1603 cash grant, a program that expires on December 31, 2011, and who can place a project in service by December 31, 2012.&nbsp; Since projects seeking the cash grant will need to &quot;begin construction&quot; (as that&nbsp;concept&nbsp;is defined in&nbsp;Section 1603) by December 31, 2011, the November 1 target execution date will likely be critical for developers seeking to arrange project financing before year end.</p>

<title>Puget Sound Energy Files for WUTC Review of &quot;All-Source&quot; RFP</title>
<description><![CDATA[<p>Puget Sound Energy (PSE) has filed with the Washington Utilities and Transportation Commission (WUTC) a <i>Request for Proposals for All Generation Sources</i> (the all-source RFP) and a <i>Request for Proposals for Electric and Demand Side Resources </i>(energy-efficiency RFP)<i>. </i>PSE filed the draft all source RFP on August 1, 2011 and plans to issue a separate energy efficiency RFP later. &nbsp;</p>
<p style="margin: 0in 0in 0pt">Under the all source RFP, PSE is seeking proposals for energy generation resources as capacity generation resources,&nbsp;as well as&nbsp;transmission products from BPA&rsquo;s system to PSE's system.&nbsp;PSE is willing to consider both existing generation resources and resources that are under development but expected to achieve commercial operation no later than December 2015.&nbsp;According to PSE, a revised assessment of its portfolio needs and peak customer power requirements demonstrates a need for approximately 500 MW of capacity by the end of 2012. &nbsp;PSE would be willing to consider various commercial arrangements under the RFP, including power purchase agreements, temporal exchange agreements, ownership arrangements (e.g.,&nbsp;a transfer of development assets, a build-transfer arrangement, or sale of an existing asset), as well as transmission-only products from BPA&rsquo;s system.</p>
<p style="margin: 0in 0in 0pt">&nbsp;</p>
<p style="margin: 0in 0in 0pt">PSE will be hosting an RFP Proposal Conference on August 16, 2011, in Bellevue, Washington, to discuss the all-source RFP.&nbsp;To register for the conference, email <a href="mailto:janice.brown@pse.com">janice.brown@pse.com</a>.&nbsp;Public comments on the draft RFP are due on September 2, 2011, and PSE expects to receive WUTC approval by September 28.&nbsp;If the schedule holds, PSE plans to issue the final RFP solicitation on October 5, 2011. &nbsp;PSE expects to select a final short list and notify respondents in 1Q 2012.</p>

<title>USFS Finalizes Long-Awaited Wind Energy Directives</title>
<description><![CDATA[<p>My colleagues <a href="http://www.stoel.com/showbio.aspx?Show=2103">Heath Curtiss</a> and <a href="http://www.stoel.com/showbio.aspx?Show=2765">Sarah Stauffer Curtiss</a> are reviewing the final directives for US wind energy special use authorizations that the Forest Service issued today. Here&rsquo;s their brief update, which will be followed by a more detailed energy law alert:</p>
<p>Nearly five years after issuing its draft directives, on August 4, 2011, the U.S. Forest Service issued final directives for wind energy special use authorizations. The new directives supplement existing Forest Service guidance on wildlife and special uses, but specifically address issues associated with the permitting and siting of wind energy facilities. Key components of the new directives can be found in a new chapter, &ldquo;Wind Energy Uses,&rdquo; in the Special Uses Handbook and a new chapter, &ldquo;Monitoring at Wind Sites,&rdquo; in the Wildlife Monitoring Handbook. Generally speaking, the Forest Service modeled its wind energy directives after the Bureau of Land Management Instruction Memoranda on wind energy development. There are, however, key differences, including, for instance, significantly greater potential for competitive bidding and substantially more explicit wildlife monitoring requirements. <title>CPUC Seeks Comments in AB 2514 Electric Storage System (ESS) Docket R.10-12-007</title>
<description><![CDATA[<p>California&rsquo;s AB 2514 directs the California Public Utility Commission (CPUC) to determine appropriate targets, if any, for load-serving entities to procure viable and cost-effective energy storage systems. If the CPUC decides that targets are appropriate, it is supposed to set dates for achieving those targets.</p>
<p>As a follow up to an AB 2514 workshop held on June 28, 2011, Administrative Law Judge Amy C. Yip-Kikugawa issued a ruling asking for comments on the presentations made at the workshop by the California Energy Commission, the California Independent System Operator, Southern California Edison, the California Energy Storage Alliance, AES Energy Storage, Beacon Power Corporation and KS Engineers, all of which were attached to the ruling.  The ruling asks the parties to comment on whether they agree or disagree with the presentations.</p>
<p>In addition, the ruling seeks comments from parties on the following questions:</p>
<ol>
    <li>Which barrier(s), either identified by the presenters or the CPUC, do you believe present the greatest impediment to more widespread usage of energy storage and development of ESS in California?</li>
    <p>&nbsp;</p>
    <li>Are there other barriers that were not identified during theworkshop? Please explain how these other barriers impede theusage or development of energy storage and whether they needto be resolved at the Commission or other forums.</li>
    <p>&nbsp;</p>
    <li>To whatextent can the Commission assist in removing these barriers?In your opinion, are there certain barriers that need to beresolved first, and therefore have higher priority?</li>
</ol>

<title>EPRI Project to Develop Functional Requirements for Customer Energy Storage System (CESS) Launched - Public Webcast July 22</title>
<description><![CDATA[<p>The Electric Power Research Institute (EPRI) is developing a new report to define functional requirements for customer energy storage systems (CESS). The project is engaging energy storage stakeholders to collaborate on the development of the functional requirements through a public process.</p>
<p style="margin: 0in 0in 0pt">EPRI's effort is designed to create an understanding between electric utilities and their storage needs, the manufacturers and suppliers of customer energy storage systems, and customers of the systems.</p>
<p style="margin: 0in 0in 0pt">&nbsp;</p>
<p style="margin: 0in 0in 0pt">A webcast open to all stakeholders will&nbsp;take place&nbsp;on Friday, July 22, 1:30 PM &ndash; 3 PM ET. During that webcast, attendees&nbsp;will be&nbsp;asked to help refine the draft document, and provide comments. <title>PSU&apos;s Hatfield School of Government Offers &quot;Summer Series on the New Energy Economy&quot;</title>
<description><![CDATA[<p>This summer, the Center for Public Service at the Hatfield School of Government at Portland State University will be offering a series of short, 2-3 day classes under an umbrella called the <b>&quot;Summer Series on the New Energy Economy.&quot;</b> &nbsp;These are non-credit courses, specifically designed for energy industry leaders, a wide range of professionals, and other community members with an interest in learning more about key energy topics.The series is being coordinated by <a href="http://www.pdx.edu/eli/hammarlund">Jeff Hammarlund</a>, one of PSU&rsquo;s adjunct faculty, who in recent years has taught a series of popular classes on various aspects of the Smart Grid.<br />
